Acceptable Use Policy

This Acceptable Use Policy (“Policy”) sets out the rules and restrictions for using Atom Telecom’s services, platforms, and networks (“Services”). By accessing or using our Services, you agree to comply with this Policy, applicable laws, and any regulatory requirements under the Australian Communications and Media Authority (ACMA).

Atom Telecom reserves the right to suspend, restrict, or terminate Services where your usage breaches this Policy.

1. Purpose

The purpose of this Policy is to:

  • Ensure the integrity, security, and availability of Atom’s network.
  • Protect customers, users, and third parties from fraudulent or harmful activity.
  • Maintain compliance with ACMA, TCP Code 2019, Spam Act 2003, and other telecommunications regulations.

2. Prohibited Uses

You must not use Atom’s Services to:

2.1 Unlawful Activity
  • Engage in any activity that violates Australian or international laws, including the Telecommunications Act 1997 and Privacy Act 1988.
  • Host, publish, or distribute unlawful, defamatory, offensive, or indecent material.
  • Impersonate any person, business, or organisation.
2.2 Spam & Messaging Rules
  • Send unsolicited commercial electronic messages (spam) in breach of the Spam Act 2003.
  • Use false or misleading sender IDs, including unverified alphanumeric IDs.
  • Send bulk SMS or marketing messages without obtaining recipient consent.

Note: Atom complies with ACMA’s SMS Sender ID Registration program. Unregistered sender IDs may be blocked or filtered.

2.3 Network Abuse
  • Use automated tools (e.g. diallers, bots, or SIM boxes) to exploit the network.
  • Engage in behaviour causing network congestion, degradation, or denial of service.
  • Circumvent usage controls or exploit security vulnerabilities.
2.4 Fraudulent or Harmful Conduct
  • Use the Services for identity theft, phishing, financial scams, or other deceptive practices.
  • Host malware, ransomware, or other malicious code.
  • Attempt unauthorised access to Atom’s systems, other users’ accounts, or connected networks.

3. Fair Use

Certain Atom Telecom plans are subject to our Fair Use Policy:

  • Usage must be reasonable and consistent with that of an average customer.
  • Non-ordinary use — including high-volume auto-dialling, persistent mass messaging, or data abuse — may trigger service restrictions.
  • Atom reserves the right to monitor network activity to ensure fair use across all customers.

4. Regulatory Obligations

Atom Telecom complies with Australian telecommunications regulations and expects customers to do the same:

  • Spam Act 2003 — requires consent before sending marketing messages.
  • TCP Code 2019 — governs customer rights and protections.
  • Integrated Public Number Database (IPND) — accurate customer data must be provided for emergency services compliance.
  • ACMA Sender ID Registration — mandatory for certain SMS campaigns.

5. Enforcement

We may, at our discretion, take one or more of the following actions where a breach of this Policy occurs:

  • Issue a warning.
  • Suspend or restrict Services temporarily.
  • Terminate Services without prior notice in serious cases.
  • Report unlawful conduct to law enforcement or regulatory authorities.
