Welcome to Atom Telecom (“Atom”, “we”, “our”, “us”). By accessing or using our websites, platforms, or services, you agree to comply with these Terms of Use, our Master Services Agreement (MSA), and all applicable laws and regulations. If you do not agree, you must not use our services.

1. Governing Agreement

1.1 Master Services Agreement

Atom’s services are provided under the terms of our Master Services Agreement (“MSA”), which forms part of these Terms of Use and governs your use of our products and services.

1.2 Precedence of Agreements
  • If you have signed a separate written agreement with Atom, that agreement takes precedence over these Terms.
  • If no separate agreement exists, your use of Atom’s services is automatically bound by the standard MSA.

2. Our Services

Atom Telecom provides Unified Communications as a Service (UCaaS), including:

  • Voice and call services
  • Mobile plans and messaging exchange
  • Hosted PBX and Microsoft Teams direct routing
  • API-driven integrations and white-label solutions

Details of features, pricing, and inclusions are available via your account portal or rate card.

3. Your Responsibilities

When using Atom’s services, you must:

  • Keep your account credentials secure.
  • Provide accurate and up-to-date contact and billing information.
  • Comply with all applicable laws, ACMA regulations, and industry codes.
  • Avoid unlawful, fraudulent, abusive, or harmful usage.
  • Ensure any connected equipment meets required technical and safety standards.

4. Fair Use

Certain services are subject to Atom’s Acceptable Use Policy. Excessive or unreasonable usage, such as:

  • CLI spoofing
  • Unverified SMS campaigns
  • SIM box deployments
  • Auto-dialling or bulk traffic without consent

…may result in traffic shaping, suspension, or termination in line with the MSA and ACMA guidelines.

5. Numbering & Caller ID

Telephone numbers, mobile numbers, and IP addresses provided by Atom are regulated under the Telecommunications Numbering Plan 1997. You do not own these resources; your right to use them may cease on cancellation or as required by law.

6. Privacy & Data Handling

Atom collects, uses, and manages personal data in accordance with:

  • The Privacy Act 1988 (Cth)
  • The Australian Privacy Principles (APPs)
  • Atom’s Privacy Policy

We may be required by law to disclose certain customer data, such as to:

  • The Integrated Public Number Database (IPND) for emergency services.
  • Law enforcement or regulatory bodies under lawful requests.

7. Suspension & Termination

In addition to rights outlined in the MSA, we may suspend or terminate services if you:

  • Breach these Terms or the MSA
  • Fail to comply with ACMA obligations
  • Engage in fraudulent or harmful activity
  • Fail to pay invoices on time
  • Are required by law or regulator direction

8. Limitation of Liability

To the maximum extent permitted by law:

  • Atom Telecom excludes all liability for indirect, incidental, or consequential losses.
  • Our total cumulative liability for any claim is capped at AUD $100,000, unless otherwise required by law or a signed MSA overrides this limitation.

9. Regulatory Compliance

Atom complies with ACMA, the Telecommunications Act 1997, the Spam Act 2003, and the TCP Code 2019.

Customers must also comply with relevant regulatory obligations, including:

  • Providing accurate customer data for IPND
  • Registering SMS Sender IDs where required
  • Obtaining express consent for marketing communications

10. Governing Law

These Terms are governed by the laws of Queensland, Australia, and any disputes will be resolved in the courts of Queensland.
